Abstract
Construction Project is an important part in a regional development. In order to determine the rights and responsibilities for each party, contract is a media to reach an agreement during the deal. Construction Claim, Variation Order, and anything that leads to dispute happened because of rights and claims for compensation from the parties. In other words, this matter happened as a result of their loss and not fulfilled rights which they were supposed to get. It takes time and cost to settle disputes which will adverse the construction progress. Therefore, there is in need of a system procedure that can prevent disputes. Internationally, the FIDIC document has been long known as a contractual rule which is used by many countries and is well-known for issuing contract requirements documents that adhere to the principle of "Balance Risk Sharing" between two parties, namely imposing risks to the party that is most capable to control the risks. However, the use of FIDIC system is still rarely applied in Indonesia. FIDIC has published several books for construction contract basis and from the results of the study, it is found the comparisons and differences between the two books that were published by FIDIC, FIDIC Red Book and FIDIC Yellow Book 2017.
