Abstract
Penyebaran identitas anak berhadapan dengan hukum merupakan suatu bentuk pelanggaran terhadap hak-hak anak yang telah dilindungi oleh undang-undang anak. Ditemukannya kasus penyebaran identitas anak yang berhadapan dengan hukum sebagai pelaku kejahatan seperti yang terjadi pada portal berita Okezone dan Kompas Online, ada bentuk pelanggaran yang telah dilakukan jurnalisme kedua media online tersebut yaitu melanggar ketentuan Undang-Undang Nomor 40 Tahun 1999 tentang Pers, Kode Etik Jurnalistik, Undang-Undang Nomor 32 Tahun 2002 tentang Penyiaran, dan Pedoman Perilaku Penyiaran (P3) dan Standar Program Siaran (SPS). Masalah pemberitaan anak yang berhadapan dengan hukum yang seringkali dipublikasikan melalui media online berbentuk media sosial yang seringkali bebas mempublikasikan identitas anak yang berhadapan dengan hukum tanpa adanya pengaburan identitas, foto wajah anak dan identitas lainnya. Permasalahan ini juga serharusnya mendapat perhatian dari aparat penegak hukum. Namun sayangnya, meskipun seringkali ditemukan kasus publikasi identitas anak yang berhadapan dengan hukum dilakukuan oleh pemilik akun-akun media sosial, namun penegakan hukum untuk pelanggaran ini jarang sekali diproses secara hukum sehingga kasus-kasus serupa seringkali timbul tenggelam dalam artian ada potensi penyebaran identitas pribadi anak yang berhadapan dengan hukum tersebut yang disebarkan melalui media sosial. ABSTRACT TITLE TITLE: Aspects of Law Enforcement Against Children Allegedly a Criminal Actor in Online Media Coverage in the Perspective of Law No. 11 of 2012 concerning the Criminal Justice System for Children STUDENT NAME: Andreas Eka Prasetya NIM: 207181005 KEYWORDS: Dissemination of the child's identity, dealing with the law, perpetrators of crime, online media CONTENTS ABSTRACT Dissemination of the child's identity in relation to the law is a form of violation of the rights of children who have been protected by child law. The discovery of cases of spreading the identity of children who are dealing with the law as perpetrators of crime as happened in the Okezone news portal and Kompas Online, there is a form of violation that has been carried out by the journalism of both online media, namely violating the provisions of Law Number 40 of 1999 concerning the Press, the Journalistic Code of Ethics , Law Number 32 of 2002 concerning Broadcasting, and the Broadcast Code of Conduct (P3) and Broadcast Program Standards (SPS). The problem of the reporting of children in conflict with the law which is often published through online media in the form of social media which is often free to publish the identity of children who are in conflict with the law without any blurring of identity, photographs of the child's face and other identities. This problem should also receive attention from law enforcement officers. But unfortunately, although there are often cases of publication of the identity of children in conflict with the law carried out by the owner of social media accounts, law enforcement for these violations is rarely processed legally so that similar cases often arise sinking in the sense that there is potential for the spread of the child's personal identity who are dealing with these laws which are spread through social media.
