Abstract

Pendaftaran tanah diatur Undang-Undang Pokok-pokok Agraria (UUPA) Pasal 19 kemudian Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah bertujuan memberikan jaminan kepastian hukum atas tanah, sejalan pemanfaatan tanah di Indonesia semakin meningkat kepelosok daerah, pengusaha yang membutuhkan tanah sebagai sarana usahanya seperti PT. Sinar Wijaya Plywood Industries melakukan permohonan Hak Guna Bangunan atas tanah yang didiami masyarakat adat suku Woriasi, menarik diteliti karena di sisi lain eksistensi tanah masyarakat adat sebagaimana Pasal 3 UUPA bahwa hak-hak ulayat masyarakat hukum adat sepanjang keberadaanya masih ada diakui maka bagaimana prosedur pelaksanaan pelepasan hak atas tanah adat suku Woriasi sebagai syarat pemberian Hak Guna Banguan pada Badan Hukum PT. Sinar Wijaya Plywood Industries telah memberikan kepastian hukum dan bagaimana kedudukan dan keberlakuan Surat Keputusan Kementerian Agraria dan Tata Ruang/Kepala Badan Pertanahan Nasional Nomor 34/HGB/KEM/ATR/BPN/ VI/2019 terhadap pelepasan hak tanah adat telah sesuai dengan perundang-undangan yang berlaku. Metode Penelitian yang digunakan metode penelitian yuridis empiris melalui pendekatan secara sosiologis data yang dikumpulkan dari lapangan dianalisis secara deskriptif kualitatif dimana data primer maupun data sekunder yang telah diperoleh kemudian dianalisis berdasarkan teori Perlindungan Hukum Satjipto Rahardjo, teori kewenangan merupakan konsep penting dalam Hukum Tata Pemerintahan dan Teori Kepastian Hukum Menurut Gustav Radbruch terdapat dua macam pengertian kepastian hukum yaitu kepastian oleh hukum dan kepastian hukum dalam atau dari hukum serta peraturan yang berlaku. Kesimpulan dari pelepasan hak atas tanah adat suku Woriasi terjadi sebelumnya antara masyarakat adat dengan badan hukum telah sepaham karena musyawarah disertai terpenuhinya regulasi permohonan Hak Guna Bangunan, Negara pemegang kekuasaan tertinggi dapat mengatur peruntukan dan pemanfaatan tanah dapat dipertimbangkan aspek usulan PT. Sinar Wijaya Plywood Industries dapat dipertanggungjawabkan pemohon maka ditetapkan Keputusan Nomor 34/HGB/KEM/ATR/ BPN/VI/2019 adalah legalitas proses permohonan Hak Guna Bangunan. Saran penelitian kepada pemerintah agar mengeluarkan regulasi seimbang untuk semua pihak dan khususnya kantor pertanahan menegakkan integitas sehingga antara pembangunan industry dan pelestarian alam bangsa selalu keseimbangan, selalu ceck and balance, kepada pihak baik swasta dan masyarakat selalu bijak untuk selalu berpikir dalam melepaskan hak atas tanahnya, kehati-hatian akan menghindari persoalan kepentingan dikemudian hari. Alongs with the use of Indonesia land that increasingly to remote area, the businessman that need land as the business facility such as PT. Sinar Wijaya Plywood Industries did a request of Building Right to the land that occupied by the community of Woriasi tribe. Interesting to be researched with the problem because in other side the existence of the custom society as in Article 3 UUPA that as long as the existence of the customary law communities, its still admitted so how the application procedure of the customary land Woriasi tribe relinquishment as the grants of Building Right to legal agency that is PT. Sinar Wijaya Plywood Industries already give the legal certainty and how the validity of Decree of the Ministry of Agrarian and Spatial Planning / Head of the National Land Agency Number 34 / HGB / KEM / ATR / BPN / VI / 2019 towards the customary land relinquishment already appropriate with the current regulation. The data was collected from the field was analyzed descriptively qualitative where the primer and secondary data then analyzed based on Satjipto Rahardjo Legal Protection theory. Authority theory is an important concept in Governance Law and Legal Certainty Theory according to Gustav Radbruch there are two explanation of legal certainty, that are certainty by law and law certainty in or from applicable laws and regulations. The conclusion from the customary land Woriasi tribe relinquishment happened before between custom society with legal agency was agreed because discussion and fulfilment the application of regulatory requirements Building Right. The state that holds the highest power could reguate the use of land also could be considered the aspects of the proposal that delivered and could be responsible by the applicant so appointed Decree of the Ministry of Agrarian and Spatial Planning / Head of the National Land Agency Number 34 / HGB / KEM / ATR / BPN / VI / 2019 is legality of the process of Building Right application. Suggestion of this research to government is to give balance regulation for all parties and especially the land office upholds integrity so between industrial development and preservation of the nation's nature always balance to the private parties and the community and also the community always wise to think to relinquish the land.
