Abstract

This article aims to provide a comprehensive overview of the controversy surrounding SEMA No. 2 of 2023 in Indonesia concerning interfaith marriages. The research results indicate the diversity of religions in Indonesia, the applicable legal regulations, the authority of judges, and the importance of justice and legal certainty are highly relevant considerations. The controversy surrounding SEMA is indeed complex and reflects the tension between religious, legal, and judicial freedom aspects. As in Constitutional Court Decision No.68/PUU-XII/2014 where the panel of judges rejected Judicial Review Article 2 paragraph (1) and stated that marriages between different religions according to positive law in Indonesia cannot be carried out. So this view is very sensitive and requires in-depth discussion and careful consideration by various parties, including legislators, the courts and the wider community. As a solution, this debate should be directed towards finding a resolution that respects individual rights, strengthens Indonesia's diversity, and ensures adequate legal and administrative protection for interfaith marriages.
