Abstract

In Indonesia, there are lots of international and government projects because of the development of globalization era nowadays. Both the international and government side have a regulation to made an international contract model, one of the common contract that often used is FIDIC. However, the phenomenon which often occurred is an construction claim from the projects that use FIDIC contract model, especially FIDIC Design-Build (Yellow Book). Therefore, this phenomenon needed to be a research about the causal factor of construction claim in the projects that use FIDIC Design-Build 1999 and become a reference to analyse FIDIC Design-Build 2017 which is not a common things to do by other writers. This research use factor analysis to get the dominant causal factor of claim under FIDIC Design-Build 1999, then continue with the qualitative analysis on FIDIC Design-Build 2017 by the point of related clause to determine the problems of the factor are already include or not. The Results of the analysis Obtained the 3 dominant factors which are, Inadequate Site Investigation, Difference in Interpretation, and Over Inspection. The result of the analysis found that the matter of the point clause analysed, that factors already ”covered” in FIDIC Design-Build 2017. Also the Sub-clause of Force Majuere changed become Excetional Event.
