Abstract

abstrak (A)Name: EkoWijaya (NIM: 205090103) (B) Title :The Position Of Tuvaluan As Environmental Refugee On The Basis Of International Human Rights Law. (C)Pages: vi + 66+35 + 2013 (D)Keyword :Position, Tuvaluan, Environmental Refugee, International Human Rights Law (E) Content: Globalization was indeed happening. The climate change was following behind. The environment faces the reality where environment degradation is occurring. This environment degradation is human mistake. Some people still do not fear the impact of climate change since the impact to their state was on minimum scale. Different situation occurred in Tuvalu, a small state located in Pacific Island Region. Scientist predicted that all of the territories of Tuvalu will be permanently inhabitable in next few decades. The actual land loss has already occurred in Tuvalu since the rise of sea-level is taking away the dry-land of Tuvalu. This event creates the ?environmental cause? refugee which should flee to another state territory. Ironically such protection for ?environmental cause? refugee was not ruled by international law. United Nations High Commissioner on Refugee as the international agency works on the field of refugee also could not protect them since their regulation was only bound to the ?political cause? refugee. The question rises to who they are and what protection is available for them. According to the analysis, all the state was the polluters and having contributions to climate change. Hence, they are held responsible as the actor of climate change and bound to help the Tuvaluan. The Tuvaluan was protected by human rights as the human rights law counted the inherent right to life as non-derogable rights. This regulation made the Tuvaluan have the right to keep their life by conducting any legal measure to protect them and not being abandoned in inhabitable territory.(F)Reference:35 (1949-2013) (G) Promoter: Drs.
